Terms and conditions of use of the psl.eu website

1. Legal notice and credits

The website www.univ-psl.fr is published and managed by the Université PSL and the Fondation de Coopération Scientifique Paris Sciences et Lettres - Quartier Latin (hereinafter together referred to as "PSL"), whose registered office is located at 60 rue Mazarine - 75006 Paris.

The publication director is the legal representative of Université PSL and Fondation de Coopération Scientifique Paris Sciences et Lettres: Alain Fuchs.

2. Fields of application

The website www.psl. eu is PSL's institutional portal (hereinafter referred to as the "Institutional Portal" or "Site"), which in turn links to several platforms (hereinafter referred to as the "Platform(s)"), applications (hereinafter referred to as the "Application(s)") and sites (hereinafter referred to as the "Application(s)"), namely the Admissions Platform, the Call for Projects Platform, the PSL-Sport Registration Platform, the PSL-Housing Housing Platform; the PSL-Sport and MyPSL applications; the PSL-Explore, Colle Doctoral, CPES sites, and any other existing or future site, platform or application for which PSL is the data controller (the Institutional Portal, Platforms and Applications being referred to hereinafter together as the "Site"),

The GCU and the Privacy Policy apply to all sites, platforms and applications accessible from the PSL Institutional Portal and for which PSL is the publisher/processor.

The Site is governed by these general terms and conditions of use (hereinafter the "GTCU").

The provisions of these GCU govern the relationship between PSL and any person who browses the Site, uses the various admission services, calls for projects and donations on the Platforms (hereinafter the "Services") and/or interacts with PSL in connection with the use of the Site (hereinafter the "User(s)").

The GCU may be consulted directly on the Site at any time. PSL reserves the right to modify them at any time. The modified GCU will take effect on the date they are put online on the Site and are deemed accepted without reservation by any User browsing the Site after they have been put online. The applicable GCU are those in force on the day of browsing the Site.

3. Minors

Minors may use the Site and Services under the responsibility and with the authorization of their legal guardian.

4. Intellectual property rights

The User acknowledges that the Site and its content (hereinafter the "Content" including, but not limited to, all text, graphics, images, logos, names, trademarks, denominations, sounds, photographs, iconographies, videos, drawings, data, software or other) are protected by intellectual property law and are the exclusive property of PSL or are licensed to PSL.

The Site and/or its Content may not under any circumstances be modified, reproduced, represented, distributed, displayed, marketed, integrated into a derivative work or otherwise, in whole or in part, in any medium whatsoever. In general, the Site and its Content may only be used in the context of browsing the Site and, where applicable, to use the Services.

The use of all or part of the Site and/or its Content, in particular by downloading, reproduction, transmission or representation for purposes other than those provided for in these GCU is strictly prohibited.

Subject to compliance with these GCU, PSL grants Users a personal, non-exclusive and non-transferable right to access and use the Site and its Content for the sole purpose of consulting the Site and using the Services.

With the exception of the foregoing, Users are strictly forbidden to :

  • copy, reproduce, represent, disseminate, distribute, publish, permanently or temporarily, all or part of the Site and/or its Content by any means and on any medium known or unknown to date;
  • create derivative works from the Site and/or its Content;
  • modify, translate, adapt or arrange all or part of the Site and/or its Content;
  • disassemble, decompile or reverse engineer the Site and/or its Content;
  • distribute, transmit, broadcast, sell, lease, license or exploit, in any way whatsoever, without the express prior written consent of PSL, all or part of the Site and/or its Content.

5. Personal data

When Users browse the Site, create a personal account and/or use the Services, PSL collects and uses personal data concerning them.

PSL is committed to ensuring the protection of Users' personal data. For more information on how PSL collects, uses and processes personal data, the User is invited to consult PSL's Privacy Policy available here.

6. Hypertext links

The Site may provide links to other websites. Insofar as PSL cannot exercise control over these third-party websites, PSL makes no commitment as to the availability and content of these sites, and declines all responsibility for the content, advertising, products, services or any other material available on or from these external sites or sources.

PSL also disclaims any liability for any actual or alleged damage or loss arising out of or in connection with the use of, or reliance on, any content, goods or services available on such third-party websites.

7. Warranty - Liability

The User's liability

When using the Site and/or accessing the Services, the User undertakes to :

  • remain courteous and refrain from making any comments and/or behaving in a derogatory manner likely to harm PSL, other Users or any third party in any way whatsoever;not to attempt to disrupt or compromise the integrity or security of PSL's system, or to decrypt any transmission to or from the servers of the Site or Services;
  • download invalid data, viruses, worms or any other software agent via the Site or Services;
  • usurp the identity of any person or entity, use a false name or make false statements when using the Site or Services;
  • engage in any act of piracy, send unsolicited e-mails or carry out any phishing operation, against PSL or other Users;
  • not to use the Site or the Services in any way that is not in accordance with these GCU.

Should the User fail to comply with any of these obligations, he/she shall be solely liable for any damage caused by him/her to PSL, other Users or third parties. In this respect, the User undertakes to indemnify PSL against all claims, actions or recourse of any nature whatsoever that may result therefrom, and to compensate PSL for any damages, costs or indemnities arising therefrom.

PSL's liability

PSL ensures that the Site is regularly updated, but cannot guarantee Users the accuracy and/or timeliness of all information published. Consequently, PSL declines all responsibility for any inaccuracies, omissions or errors.

The Site is normally accessible 24 hours a day, 7 days a week, subject to :

  • force majeure ;
  • Internet network availability;
  • temporary suspension of the Site for technical reasons related to Site updates, maintenance or any other technical cause.

PSL undertakes, on the basis of an obligation of means, to provide access to the Site and Services, to act with diligence and competence and to make every effort, within reasonable limits, to remedy any malfunction brought to its attention.

PSL may, however, find itself obliged to suspend the Site or Services temporarily or permanently without notice, for technical maintenance reasons whatever the origin or cause, without this entailing any liability on PSL's part.

It is specified that the Internet network and the computer and telecommunications systems used in connection with access to and use of the Site are not error-free and interruptions and breakdowns may occasionally occur. PSL cannot be held liable for any inconvenience or damage associated with the use of the Internet. It is the responsibility of Users to take all appropriate measures to ensure the security of their equipment, data, software or other, in particular against contamination by any virus and/or attempted intrusion of which they could be victims.

PSL also declines all responsibility:

  • In the event of direct or indirect damage caused to the User, whatever its nature, resulting from the content, access or use of the Site (and/or sites linked to it),
  • In the event of abnormal use or illicit exploitation of the Site.

8. Applicable law - Disputes

These GCU are governed by French law.

In the event of a claim or dispute concerning the application, interpretation or execution of these GCU, the parties undertake to seek an amicable settlement to the dispute concerned before any legal action or recourse to a mediation procedure. Failing amicable settlement, the French courts shall have sole jurisdiction.

9. Miscellaneous

In the event that one or more of the stipulations of the GCU should be considered invalid or unenforceable by a competent court or by applicable law or regulation, such stipulation(s) shall be deleted without affecting the validity and enforceability of the other provisions of the GCU.

PSL's failure to invoke any stipulation of these GCU shall not be deemed a waiver of the benefit of said stipulation or of the right to invoke said stipulation at a later date and/or to claim compensation for any breach of said stipulation.
